These Terms & Conditions ("Terms") govern your use of the DarianKrostFilms website and your engagement of our videography, editing, and content creation services. By accessing our website or booking services with us, you agree to these Terms.
1. Services
We provide videography, photography, editing, FPV drone operation, and social media content production. The specific scope of work, deliverables, and timelines will be outlined in a quote, proposal, or written agreement provided to you.
2. Bookings & Deposits
- Project dates are not confirmed until a deposit has been paid.
- Deposits are generally non-refundable but may be transferable to a new date, subject to availability.
- Unless otherwise agreed in writing, the remaining balance is payable before final delivery of any content.
3. Cancellations & Rescheduling
- Cancellations made within 72 hours of the scheduled shoot may incur a cancellation fee.
- Weather or unforeseen circumstances may require rescheduling. We will work with you to find a new date; additional travel or location costs may still apply.
- Significant changes to the brief after booking may result in additional fees.
4. Content Delivery & Revisions
- Estimated delivery timelines will be outlined in your quote or proposal and may vary based on project scope.
- Rush delivery may be available for an additional fee.
- Most projects include 1–2 rounds of reasonable revisions unless otherwise specified. Additional revision rounds may incur extra charges.
5. Client Responsibilities
You agree to:
- Provide accurate information about your project and expectations.
- Arrange access, permissions, and approvals for locations and participants where required.
- Ensure a safe working environment for all crew and equipment.
- Be punctual for shoot days and provide timely feedback during the edit process.
Delays in communication or approvals may extend delivery timelines.
6. Copyright & Usage Rights
- Unless otherwise agreed in writing, DarianKrostFilms retains full copyright to all footage filmed and content created.
- Upon full payment, you receive a license to use the final delivered content for your business, marketing, and promotional purposes.
- Raw footage and project files remain the property of DarianKrostFilms and may be supplied at an additional cost if agreed.
- We reserve the right to use selected content for our portfolio, showreel, website, and social media, unless you request otherwise in writing prior to the project.
7. Payments & Fees
- Accepted payment methods may include bank transfer, Stripe, or other agreed options.
- Invoices are payable by the due date stated. Late payments may attract additional fees or pause work until payment is received.
- Travel, accommodation, location hire, additional crew, and specialised equipment may be charged separately where required.
8. Limitation of Liability
- We take reasonable care in planning and executing all projects, but we are not liable for delays, cancellations, or loss of footage caused by events beyond our control (including equipment failure, extreme weather, or safety concerns).
- Our total liability for any claim arising out of our services is limited to the total amount paid by you for that project.
- We are not responsible for any indirect, incidental, or consequential loss arising from the use of our services or content.
9. Website Use
By using the DarianKrostFilms website, you agree not to:
- Copy, reproduce, or distribute site content without permission.
- Attempt to hack, disrupt, or misuse any part of the website.
- Use the website for unlawful or unauthorised purposes.
10. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or legal requirements. The "Last updated" date above indicates the latest revision. Continued use of our website or services after changes means you accept the updated Terms.
